
The External Force Investigation Team (“EFIT”) filed the first Quarterly Report with the United States District Court, District of New Mexico (“District Court”)
Darryl S. Neier, who was appointed as the External Force Investigation Team Administrator in Albuquerque, NM on May 2, 2021, named New Jersey Attorney William L. Hurlock, Esq. as his Deputy Administrator (https://hurlocklaw.com/) and Darriell Bone as Lead Supervisor. Together they lead a team of 15 EFIT Investigators conducting joint investigations with The Albuquerque Police Department (“APD”) Internal Affairs Force Division (“IAFD”).
The APD has been under a Consent Decree with the United States Department of Justice (“DOJ”) after a Pattern or Practice Investigation of APD was completed in November 2014, and a monitor appointed in January 2015.
With the potential of a Contempt of Court proceeding in the District Court, the City of Albuquerque, NM entered into a Federal Stipulated Agreement with the United States Department of Justice (“DOJ”), Case 1:14-cv-01025-JB-SMV (Doc. 720) on February 26, 2021.
In part, the Stipulated Agreement directed the City to establish an EFIT and hire an EFIT Administrator to guide and direct APD IAFD force personnel, jointly conduct investigations of Level 2 and Level 3 uses of force with IAFD, provide written assessments of Internal Affairs (“IA”) investigations carried out by IAFD, and provide written feedback on IAFD force personnel’s work product and ultimately return responsibility to APD to conduct use of force investigations independently.
