Florida adopts the Daubert Standard

In a Florida Supreme Court 5-2 opinion (SC19-107) on May 23, 2019, Florida became the latest State to adopt the Daubert standard for evidence throughout the state’s court. Expert witnesses will now have to satisfy the Daubert four prong test to determine whether the methodology is valid.

These factors are:

  • The expert’s scientific, technical or other specialized knowledge will help the trier of fact to understand the evidence or determine a fact in issue;
  • The testimony is based on sufficient facts or data;
  • The testimony is the product of reliable principles and methods;
  • The expert has reliably applied the principles and methods to the facts of the case.
